Who is the license owner (licensee)?

If you’re an individual using it for your own work, then you are the licensee. If you are a freelancer, studio, or an individual who is purchasing a font for a client job, the client is the licensee.


Font Licensing 


Below you can find an outline of how our licensing structure works - if you have any questions, don’t hesitate to get in contact with us.

First things first, what is a license?

Purchasing a license for a product isn’t like buying a physical product, such as a book. Once the book arrives through your letterbox, it’s yours forever, and you own it. It has now become your personal property. Whereas when purchasing a license, you’re paying for the right to use the product within the rules established in the specific license agreement. Even once you have the product file on your device, it remains the intellectual property (IP) of the creator/seller.

Font Licenses

Our font licensing system is split into three important choices that you need to make.

1. Licensee type: is the licensee an individual, freelancer or business


2. Size: how big is the licensee?*


3. License: what kind of license coverage does the licensee need?



*An important clarification to make in terms of the size of the licensee is not how many locations the font will be installed at, but rather how large the licensee is as a whole.

License Grant for Resharing Work

Through our terms, Type Department grants you a non-exclusive, non-transferable, and revocable license to use the purchased product under the terms outlined in the purchased EULA.

Our licenses also grants both the user, Type Department and the respective creator (“Seller") with the right to reshare works created with the font software in perpetuity, worldwide, provided that:

• The font software itself is not redistributed by the user. 

• Proper attribution and credits are given to all parties where applicable.
• The use adheres to the guidelines outlined in the Permitted Installations and Uses section of the EULA. 


By purchasing and using our products, you acknowledge and agree that these permissions comply with the German Copyright Act (Urheberrechtsgesetz, UrhG), providing both the creator and Type Department with explicit permission to the reshare work that utilises the font licensed under these terms in perpetuity, worldwide, provided that full credits are given to the user, licensee and seller.

License Termination



• Breaching any terms of our EULAs will result in termination of the license. You must then return or destroy the digital files, products or font software and certify that no copies remain in your possession.


• Unlicensed use of our products is a major breach. You must retrospectively purchase the appropriate license within seven (7) working days and provide any required information.


• Type Department reserves the right to charge for time, expenses, and legal work related to unauthorised use.

LICENSEE SIZE

1. Individual:
Ideal for personal use or small projects.

• For a one (1) user only
• Unlimited personal projects
• 1x commercial project
• Does not include third-party rights



2. Company / Freelancers
Tailored for commercial work created by freelancers, studios, companies and international organisations.

• XS: For clients or licensees with a company size of 1-5 employees.
• S: For clients or licensees with a company size of 6-24 employees.
• M: For clients or licensees with a company size of 24-50 employees.
• L: For clients or licensees with a company size of 50-199 employees.
• XL: For clients or licensees with a company size of 200-500 employees.

All of the business licenses above also include:

• 1x commercial project
• Unlimited personal projects
• Third-party rights

For businesses with more than 500+ employees or that wish to license as a group of companies, they can contact our sales team at typedepartment@type-01.com for a tailored licensing solution, usually in the form of an enterprise license agreement.

TRIALS

Any trial fonts that are downloaded from a product’s page are for testing purposes only. By downloading any trials hosted on our site, you agree and fully understand that the font(s) cannot be used for commercial or personal use, or any other use for that matter, other than testing. In order for the font to be used outside of this restriction, a full license must be bought.

desktop / print / digital ad / social media license

One of the most common options out there, our Desktop license will cover most of your commercial or non-commercial font usage needs.

Our Desktop License grants you the right to:

• Create digital images utilising the font software, such as posters, banners, social media posts, and gifs in perpetuity, per 1x commercial project. Approved formats include JPEG, PNG, EPS, GIF, MP4.

• Upload digital images utilising the font software to all social media platforms apart from streaming channels such as Twitch and YouTube. In these cases, you will need a Broadcasting License. 
-
• Upload digital images utilising the font software to URL web pages/sites.
-
• Use the font software within digital ads with no restrictions on the number of impressions, engagements, views or clicks in perpetuity. 
-
• Use the font software for printed material such as books, magazines & packaging (up to 1,000 units if sold commercially), flyers, business cards, inserts etc and may be sent as part of a file release to a pre-press bureau or printer if necessary.

• Embedded into files the Portable Document Format (PDF), PostScript (PS), and Encapsulated PostScript (EPS) types. 
-
• This license also grants you the right to utilise the licensed font software as part of a design for a product sold for financial gain that does not exceed 1,000 units. Examples include but are not limited to prints, pins, t-shirt designs, beauty products, fashion items, games etc. If you require an extension, please contact us for a quote. 

web license

Our Web License option is condensed into a single license product, with no limits on the number of monthly web page views or engagements.

Our Web License grants you the right to:
-
• Embed the font software into the CSS code of one (1x) website domain as text, such as titles, subtitles, captions and body copy.
-
A common question is whether you are allowed to upload a digital image or a GIF that utilises a font to a web URL environment. The answer is yes, you are, but you must purchase our Desktop License and WILL NOT need our Web License for this usage.

broadcasting license

Our Broadcasting EULA grants you the right to:
-
• Upload content utilising the font software in the form of digital to digital and or / physical music streaming platforms, including, but not limited to Spotify, Apple Music, Amazon Music, SoundCloud.
-
• OOO (out of home advertising)
-
• Public and or / streamed music
events
-
• Album covers
-
• Broadcast the content to an unlimited number of countries worldwide with no restrictions on collected engagements, including views, likes, impressions, and downloads (free).
-
• Broadcast video that is publicly transmitted through the following formats: Twitch, film, TV broadcasting, Youtube, movie streaming platforms such as, but limited to Netflix, Disney+, Amazon Prime, cinema, cinema advertising and custom streaming.
-
• If the font software is used for a music product, such as an album cover that is sold for financial gain over 1,000 units, you must contact us for a license extension - usually this comes in the form of a perpetual product license extension with no restrictions on the number of sales. 
-
• The creation of digital images and video is covered by the Desktop license, but if you wish to broadcast by any of the media listed above, you will need a Broadcasting License to cover that usage.

app license

Our Application license grants you the right to:
-
• Embed the font software within other software, including, but not limited to, application content (desktop or mobile or Dapps), user interfaces or other content for personal computers, mobile devices, gaming consoles, games, and smart televisions
-
• Provides no restrictions on downloads, viewers, impressions, clicks, users, and other engagements. 
-
• One app license = 1x application.

logo/wordmark license

Our Logo / Mark License grants you the right to:
-
•  Use the font software as part of the design of a logo or an iconic mark that is representative of a one (1x) company, project, or person.
-
• Trademark it in an unlimited number of countries worldwide. 
-
• Right to create digital images using the logo/mark and publish on all social media platforms, URL web pages/sites, used for digital/physical ads.
-
• Use for branded merchandise that isn’t sold commercially.

product sale license

If a digital or physical product utilises the font within its product design and exceeds the 1000 unit limit which is covered by our Desktop License, an additional license is needed. Please contact us for a quote.

corporate & custom license

A custom license can sound expensive, but this can range from a very small change in our standard licenses to a small to medium sized package of licenses to a completely custom solution to suit a large client who requires a more flexible option.

An unlimited license (also known as a corporate license) is a license that covers all types of media (i.e., desktop/print, logo/mark, social media, web, app, game and product sales) and has no limit on company size, number of locations the software is installed at, or things like web page views, commercial project total, and number of product units produced.

LICENSE RESTRICTIONS

• You may not adapt, modify, create additional versions/styles, or rename the font software file.

• Opening the font software in editing software to reveal its structure, organisation, or code is prohibited.


• Converting font formats.

• Except for third-party usages, licenses are non-transferable. Each party using the software or digital files must purchase its own license.


• Unlicensed use of the font software is a major breach. You must retrospectively purchase the appropriate license within seven (7) working days and provide any required information.

• Type Department reserves the right to charge for time, expenses, and legal work related to unauthorised use.
